“A Portsmouth man was convicted last month of punching a man in a wheelchair, breaking the victim’s jaw.
The jurors found Gregory Lewis Cooper guilty of felony unlawful wounding and recommended he serve 60 days in jail.
Prosecutors, however, argued at trial that Cooper was guilty of the much more serious charge of aggravated malicious wounding – a crime that carried a minimum sentence of 20 years.
A spokeswoman for the Commonwealth’s Attorney’s Office did not respond to requests for comment.
